Hemant Chandan Thakur v. The State Of Maharashtra And Others
1956.20wp (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 918 WRIT PETITION NO.1956 OF 2020 HEMANT CHANDAN THAKUR
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Mr M. A. Golegaonkar, Advocate for petitioner; Mr S. G. Sangle, A.G.P. for respondent Nos.1 & 2; Mr A. S. Shelke, Advocate for respondent Nos.3 & 4 CORAM : RAVINDRA V. GHUGE AND S. G. MEHARE, JJ.
DATE : 27th August, 2021 PER COURT:
1.
Since the tribe validity claim of the petitioner is pending since 2010, it would be appropriate to direct respondent No.2 - Committee to decide the said claim, as expeditiously as possible and in any case, on or before 31/03/2022.
2.
This petition is, therefore, disposed off with the above direction to respondent No.2.
3.
Respondent Nos.3 and 4 have initiated a departmental enquiry against the petitioner only for the reason that he has failed
1956.20wp (2) in submitting his tribe validity certificate, which he had undertaken to file while joining duties. As such, the said enquiry shall be kept in abeyance till the tribe validity claim is decided on or before 31/03/2022. If the claim is accepted, the enquiry shall be dropped.
4.
Needless to state, if the Committee comes to a conclusion that the petitioner is not co-operating in the proceeding, it would be at liberty to approach this Court by filing a civil application. (S. G. MEHARE, J.) (RAVINDRA V. GHUGE, J.) sjk
