The Applicant, by this Civil Application, prays for condonation of two days' delay in lodging the Second Appeal. The reasons in support of the prayer are set out in paragraphs 1, 2, 3 and 4. Mr.Bajaj, learned Advocate appearing for the sole Respondent/ CIDCO, opposed the application. His contention is that the reasons cited do not support the request for condonation of delay. The Applicant has intentionally delayed the filing of the Second Appeal. He, therefore, prays for rejection of the application.
*2* I have considered the submissions of the litigating sides. I am convinced of the reasons assigned for condonation of the delay. In the light of the above, the Civil Application is allowed. The delay of two days is condoned. Since the delay in lodging the Second Appeal is only of two days, I am not inclined to impose costs on the Applicant. The Second Appeal be registered.
