Challenge in this petition is to an order dated 18.11.2012 passed in Criminal Appeal No. 9 of 2012, by the learned Additional Sessions Judge, Omerga, rejecting appeal filed by the petitioner challenging judgment and order passed in Misc. Cri. Application No. 18 of 2010 by the learned JMFC, Lohara dated 13.03.2012, partly allowing the application of the respondent wife under the Protection of Women from Domestic Violence Act. This petition is filed in the year 2023. There is no explanation for such delay and laches. The matter was adjourned on the request of the petitioner on 09.05.2025 to 04.07.2025. On 04.07.2025, it was adjourned to 25.07.2025. On 25.07.2025, it is adjourned for today.

This Court has gone through the petition. There is no explanation given about delay and laches, except the statement that the same be condoned in the interest of justice. This Court has seen the orders passed by the learned JMFC and learned Sessions Court. No illegality or perversity is seen in the order. This Court does not find merit in the writ petition. Looking to the conduct of the petitioner also, it is seen that he is not interested in prosecuting the petition. Keeping the petition pending in such circumstances is of no avail. 03.
