Learned Counsel Shri Barde for the petitioner and learned Counsel Shri Somani for respondent No.1 agreed that the petition can be disposed of in the following terms: 1.

The petitioner shall continue as in-charge Head Master till the date of superannuation.

2.

The entitlement to the post of permanent Head Master and similarly the claim of respondent No.1 that he was superseded, shall be finally adjudicated by the School Tribunal.

Rather than deciding the application for interim relief, which in any event is rendered redundant, the School Tribunal shall decide the appeal within six months. 4.

It is made clear that if the Presiding Officer of the School Tribunal at Aurangabad is not available, the appeal shall be taken up and heard by the in-charge Tribunal. 5.

The interim order dated 28th January 2020 shall stand modified in the aforestated terms.

II.

The petition is disposed of.
