When the matter is called out, none appears for the applicant. The matter is pending since 2013 for securing presence of the respondents. It is worth to mention that the applicant preferred First Appeal against the impugned judgment and award passed by the learned Reference Court dated 26.8.2008 in LAR No .91 of 1998. The appeal came to be filed in the year 2012 but there were objections and same were not removed despite sufficient opportunity was given. Therefore, the Registration of appeal was refused by requisite order of the concerned Registrar in the year 2012 itself. Thereafter, the applicant for colossal period of 108 days did not take any steps and later on preferred the present application for setting aside the order refusing registration of appeal passed by the Registrar.

Since the year 2013 the appellant did not pursue the present application nor there were any efforts for securing presence of the respondents. In such circumstances, I do not find any propriety to keep the matter alive for securing presence of the respondents on record in this matter. Application stands dismissed for want of prosecution. No orders as to costs.
