PER COURT :

The petitioner impugns the order dated 18.12.2017. The same is rejected on the ground of clause 26.3 and 26.4 of the Secondary Schools Code. The application is given to change the caste after the petitioner has left the School. 2.

The petitioner wants to change the

2 W.P.No.1875/18 record with regard to his caste from Kunbi to Rajput. The caste Rajput also does not have the benefit of reservation.

The petitioner relies on the judgment of the Division Bench of this Court in the case of "Shaikh Shafi Ahmed Khadarsab Vs. State of Maharashtra and others" reported in 2012(5) Mh.L.J. 36.

The Education Officer, shall consider the application of the petitioner on its own merits and shall not reject it on the ground on which the impugned order is passed and shall follow the procedure as laid down in Appendix VI read with clause 26.4 of the Secondary Schools Code.

The Writ Petition is disposed of. No costs.
