The application is taken out to bring legal heirs of deceased respondent on record for the reasons set out in detail in the application.

The learned counsel submits that the application is filed within time. Appeal is still at the stage of admission. The cause survives to prosecute the appeal against the legal heirs of respondent.

Considering the submissions advanced and the facts pleaded in the application, the application is allowed in terms of prayer clause-B.
