After arguing on merits, when this Court was not inclined to interfere in the concurrent findings of fact recorded by both the Courts below, the learned advocate for the petitioner, on instructions, seeks permission to withdraw the writ petition with liberty to file review petition before the Appellate Court on the basis of handwriting expert's report received subsequently.

Permission granted.

The writ petition is dismissed as withdrawn with liberty as prayed for.

4.

The Appellate Court shall consider the period spent in prosecuting the present petition at the time of deciding delay condonation application in review petition.
