PER COURT :

Heard. The applicant has been convicted for the offence punishable under Section 307 of the Indian Penal code and therefore, sentenced to suffer rigorous imprisonment for seven years. The applicant is also convicted for the offence punishable under Section 341 of the Indian Penal Code and sentenced to suffer simple imprisonment for 1 month and to pay fine of Rs.100/-, in default to undergo S.I. for 10 days. The substantive sentences have been directed to run concurrently. He was on bail pending trial. He inflicted a stab injury to the victim. The injury is stated to be superficial in nature.

The applicant is 21 years of age. It will take time for appeal to come up for hearing. In the facts and circumstances of the case, the application is allowed. Pending the appeal, the substantive sentences imposed by learned Sessions Judge, Nanded in Sessions Case No.128/2016, by judgment and order dated 20/12/2021 are suspended and the applicant be released on bail on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount.
