We have heard Mr. Dhorde, learned senior counsel.

The learned senior counsel submits that since 1995 the post of Sarpanch of Grampanchayat Deoni (Kh.) is never reserved for SC (women). The post of Sarpanch was reserved for SC in the year 2000, but at no point of time the post was reserved for SC (women), the same ought to have been reserved for SC (women).

Mr. Kale, learned In-charge Government Pleader submits that last year the post of Sarpanch was reserved for General (women) and as such, this year by rotation it could not have been reserved for women.

The respondent has given chart showing the reservation made for the post of Sarpanch of Grampanchayat from 1995-2000 till 2020-2025. It appears that, proviso to Rule 4(A) of the Maharashtra Village Panchayat (Sarpanch and UpSarpanch) Election Rules, 1964 has been considered. 5.

In light of the above, Writ Petition is disposed of. No costs.
