The dispute pertains to payment of taxes by the petitioner factory to the respondent Gram Panchayat. Pursuant to the directions of this Court in Writ Petition No.1317/2014 and Civil Application No.10958/2017 by the order dated 05.01.2018 the Collector, Osmanabad by the order dated 09.05.2018 has directed the parties to approach the State Government for necessary approval in terms of provision of Section 125 of the Maharashtra Village Panchayat Act and the Maharashtra Village Panchayats (Payment of Lump Sum Contribution by Factories in Lieu of Taxes) Rules, 1961, for necessary permission.

The parties have now produce on record a compromise pursis which is marked 'X' for the purpose of identification. It has been duly verified before a notary. The learned advocates for the petitioner and the 1/2

905.wp.1317.14.odt contesting respondent pray that the Writ Petition may be disposed of in terms of such compromise. The parties would independently approach the authorities for grant of approval under Section 125 of the Maharashtra Village Panchayat Act.

The Writ Petition is disposed of in terms of the compromise. The amount deposited in this Court is allowed to be withdrawn by the respondent Grampanchayat along with accrued interest. (MANGESH S. PATIL, J.) habeeb 2/2
