Shantabai Tukaram Khoje Deceased Through Legal Heirs Anil Tukaram Khoje And Others v. Asha Shashikant Tarwade And Others

{1} CIVIL APPLICATION NO. 7912 OF 2023 IN Applicants Subhash Sonupant Bhingarkar (deceased) through L.Rs. & others Mr. S. R. Wakale, advocate for the Applicants Mr. Rajendra K. Temkar, advocate for Respondents No.6-A, 6B-1 and 6-B-2. By the earlier order dated 09.02.2024, one more last chance was granted on the request of learned Counsel for the appellant with understanding that names of respondents no.8 to 14 would be deleted.

The learned Counsel for legal representatives of respondent no.6, who was the original defendant, pointed out that the order of remand is under challenge and if the appeal

{2} succeeds then the respondents no. 8 to 14 will again be necessary parties.

However, it appears that in the trial Court, names of respondents no.8 and 9 are already deleted and the property, which they sold, is also removed from the suit properties.

In view of the same, the names of present respondents no.8 to 14 are deleted from the Appeal From Order.

{3} CIVIL APPLICATION NO. 1363 OF 2024 IN Shantabai Tukaram Khoje (deceased) through L. Rs.

Applicants Mr. Rajendra K. Temkar, advocate for the applicants. Mr. S. R. Wakale, advocate for the Appellants Heard rival submissions.

The legal representatives of respondent no.6 have filed this application for bringing the present applicants no.3 and 4 on record as remaining legal representatives of Respondent No.6 - Shantabai Tukaram Khoje. The appellants have already brought other legal representatives of respondent no.6 on record.

{4} As such, Civil Application is allowed in terms of prayer clauses "B" and "C". Amendment be carried out within two weeks.
