While hearing the present petition, this Court had recorded the statement made by learned Counsel for the petitioner that the petitioner - Municipal Council, Shahada will consider to appoint the applicants/respondents-employees on some of the posts sanctioned by the Director, Municipal Administration, Mumbai. 2.

Mr Patil, learned Counsel for the applicant in the background of above submits that the present applicants are in queue waiting for such appointments since their claim was allowed by the Industrial Court, Jalgaon. He submits that there are two posts of Safai Kamgar vacant with the petitioner - Municipal Council, Shahada. 3.

Mr Godsay, learned Counsel for petitioner/non-applicant - Municipa Council submits that the statement made still holds the field, as according to him, the earlier proposal submitted by the petitioner=- Municipal Council was turned down by the Director, Municipal

C.A.No.6296/2014 Administration, Mumbai. He would urge that the appontment, if any on the vacant post will be made in accordance with the law, of course by keeping in mind the statment recorded by this Court on 18th January 2005.

In view of above, as and when the vacant posts which are approved by the Director, Municipal Administration are field in by the petitioner-Municipal Council, Shahada, the petitioner-Municipal Council will consider the claim of the applicants-employees on priority in the light of the recruitment rules and the law prevailing. 5.
