PER COURT :- The petitioner was aggrieved by the communication dated 17.8.1999, by which, the seat of the President of the Municipal Council was vacated and the application filed by the petitioner requesting for disqualification of non-applicants under the provisions of the Maharashtra Local Authorities Members Disqualification Act, 1987 was rejected.

Though the learned Advocate for the petitioner fairly states that this pertains to an election held for the Bhusawal Municipal Council for the year 2000, I find that as 18 years have lapsed, there must have been at least three elections to the Municipal Council, thereafter. This Court had refused interim relief to the petitioner before amendment and even after the amendment in the petition was carried out. akl/d
