This petition challenges the order of petitioner's termination from service as Research Associate dated 12/03/2004.

Admittedly, the petitioner was appointed on contract basis for the purpose of implementation of certain scheme of respondent No. 4. The scheme was named as
2 W.P. 2064.2004 "Zonal Agricultural Research Station", which was established at Tuljapur and also at other places. The scheme came to an end in March, 2004. Thereafter, the petition was filed and adinterim stay was granted. The petitioner was granted relief in terms of prayer clause 'F', which compelled the respondents to continue the service of the petitioner till the disposal of the petition.

Since the petitioner's job was continued due to the interim order passed by this Court, the Court even directed the respondents to pay salary to the petitioner. Accordingly, salary for the period between 01/04/2004 and 28/11/2007 amounting to ` 2,80,000/- [Rupees Two Lakh Eighty Thousand] was deposited in this Court. The Court even allowed the petitioner to withdraw 50 % of this amount. In 2008, the petitioner resigned and left the job. The petitioner, thus, is not interested in continuing the petition, but since the petitioner worked as Research Associate in ZARS and subsequent to 2004 in KVK, he deserved salary. The remaining amount kept in the court, deserve to be disbursed to the petitioner.

In exchange, learned Senior Counsel for the petitioner submitted that the petitioner would not claim salary for the period beyond 28/11/2007 till he resigned in 2008. 5.
We record the above statement and dispose of the present Writ Petition by following Order.
3 W.P. 2064.2004 [i] Writ Petition is disposed of as not pressed.
[ii] The amount with interest be disbursed to the petitioner.
[iii] In view of disposal of Writ Petition, Civil Application No. 3525 of 2004 also stands disposed of.
