Learned counsel appearing for respondent no.2 submits that alternate effcacious remedy is available to the petitioner to fle an appeal under section 152-A of the Maharashtra Co-operative Societies Act, 1960 (for short the Act) before the Joint Registrar. In terms of the provisions of section 152-A of the Act, an appeal is prescribed against the rejection of nomination papers at election.

It appears that the petitioner has chosen wrong forum. The petitioner is at liberty to approach the Joint Registrar in terms of the provisions of Section 152-A of aaa/-

WP 2313.2021.odt the Act and upon fling such appeal before the Joint Registrar, the Joint Registrar to consider the time spent in pursuing this writ petition for condonation of delay if caused in fling the appeal. Writ Petition is accordingly disposed off.
