The proposal seeking approval to the appointment of petitioner as Shikshan Sevak on compassionate ground is rejected. 2.

We have heard the learned counsel for the petitioner and the learned A.G.P.

The learned counsel submits that the only reason mentioned for rejection of approval is that at the relevant time there was ban on

( 2 ) wp 1907.17 recruitment.

It has been held by this Court in number of matters that ban on recruitment does not apply to compassionate appointment. 5.

In light of that the impugned order is quashed and set aside. The Education Officer shall re-consider the proposal seeking approval to the appointment of petitioner as Shikshan Sevak on compassionate ground on its own merits, in accordance with law and policy, expeditiously and preferably within four (04) months from today. The proposal shall not be rejected on the ground on which impugned order is passed. 6.

The writ petition is disposed of. No costs.
