PER COURT :- 1.

The petitioners seek a direction to the executing Court in R.D.No. 169 of 2002 for releasing the bank guarantee imposed while disbursing the compensation amount. The petitioners have already furnished the Bank guarantee and have withdrawn the entire decreed amount. They now pray for release of the Bank guarantee.

Since the Bank guarantee was furnished in RD No.169 of 2002 and the entire decreed amount has been withdrawn, the petitioners can approach the same Court for release of the Bank guarantee before which it has been furnished, since the petitioners contend that neither the State nor the acquiring body has preferred a First appeal against the amount of compensation granted by the LAR Court. 3.
