The writ petition is abated as against the respondent No. 4. The respondent No. 4 is also one of the party before the District Superintendent of Land Records.

We have heard the learned counsel for respective parties. It is submitted that, the application is filed by the petitioner before the respondent No. 2, however, the same is not decided. 3.

In case the said application (Exhibit P-5) page 23 is pending with the respondent No. 2, then the respondent No. 2 shall decide the same on its own merits, in accordance with law

2 wp 2097.13 and after hearing all parties concerned expeditiously and preferably within a period of nine (09) months from today. The writ petition is disposed of. No costs. All contentions of respective parties are kept open.
