( 1 ) wp1549.19
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.1549 OF 2019 DEVIDAS GANPAT PAGAR
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS Mr.D.R. Irale Patil, Advocate for the petitioner. Mr.K.N. Lokhande, AGP for respondent/State.
CORAM : PRASANNA B. VARALE & S.M.GAVHANE,JJ.
DATED :
04.02.2019 P.C. :- 1.
Heard learned Counsel for the petitioner. It may not be necessary for us to refer to the facts in detail. Suffice to say that the petitioner was an employee of respondent No.2 - Zilla Parishad, Aurangabad. The petitioner was subjected to dismissal of service under an inquiry by invoking provisions of the Zilla Parishad Services (Discipline and Appeal) Rules, 1964. Being aggrieved by the order passed against the petitioner, the petitioner preferred appeal before the Divisional Commissioner. The Additional Divisional
( 2 ) wp1549.19 Commissioner decided the appeal on 26.09.2018 and the appeal was allowed. The petitioner then approached respondent No.2 - Chief Executive Officer of the Zilla Parishad with a representation requesting for payment of monitory benefits i.e. unpaid salary, as well as reinstatement. Learned Counsel for the petitioner submitted that the representation is pending for considerable long period. As such, respondent No.2 be directed to decide the representation.
2.
This being a limited grievance, the petition is disposed of with directions to respondent No.2 to decide the representation/ application dated 28.09.2018, as early as possible and not later than eight weeks from the date of order of this Court. Needless to state that the representation/application be decided on merits, if already not decided.
