1) The application is filed by original defendant No.2, present respondent No.2, for vacating interim order made by this Court. Alternate prayer is made for fixing early date of hearing of the appeal itself. During arguments, learned counsel for the present applicants, on

2 CA 10358/2009 instructions, submits that he is not pressing for the relief of making the purchasers party to the present proceeding but he is requesting only to fix the main matter for early hearing. Other side is heard.

2) The date is fixed for final hearing as 16-102015. Learned counsel Shri. Dharashive undertakes to supply private paper book within four weeks. List the matter for final hearing on 16th October 2015. The application is disposed of.
