This is an application for restoration of Writ Petition No. 12339 of 2015 which was dismissed for want of prosecution on 5 August 2016.

Learned counsel for the respondent submits that previously Civil Application No. 11801 of 2019 was filed by the applicant for restoration of the petition and this Court, by a detailed order dated 1 October 2019, had refused to restore the petition, finding the application to be thoroughly meritless.

It is submitted that without disclosing the fact about the dismissal of the previous application, the present application is filed for restoration, again with similar grounds.

Faced with this, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application. 4.
