After this matter was heard for quite sometime, the petitioner desires to withdraw this petition so as to make a comprehensive representation as regards the seniority list to be prepared in accordance with the Government Resolution dated 8.9.2008, as well as the claim of the petitioner for promotion through positions reserved for the physically challenged category. He submits that the representation will be based upon the judgment of the Apex Court in the matter of Mahesh Gupta and others Vs. Yashwantkumar Ahirwar and Others (AIR 2007 SC 3136). 2.

In the light of the above, this petition is dismissed as withdrawn with liberty to file a representation. In the event the petitioner prefers such a representation within four weeks from today, the respondent No.4 shall consider the same on its own merits. In the event, respondent No.4 is of the view that certain employees would be affected by the decision on such representation, such employees, who are likely to be affected, shall also be heard before deciding the said representation. 3.

It is expected that the representation shall be decided within six months from its receipt.
