The learned advocate for the applicant submitted that the counter FIR of the same incident was filed against the informant and witnesses for assault took place there. This fact was not pointed out in the trial Court. It is change in circumstance to consider the application of the applicant on the basis of that FIR. 2.

Considering this factual aspect, it would be proper to direct the trial Court to consider and decide the application, if it is filed before it by this applicant for granting bail.

With these observations, this application is disposed of with permission to the applicant to move the application before the trial Court for bail on the change in circumstance i.e. filing of the copy of the counter FIR in support of application for granting bail. (SANJAY A. DESHMUKH, J.) sga
