Heard learned Counsel for the applicant - wife. The respondent husband though served with notice through R.P.A.D. as well as through his sister but remained absent. 2.

The applicant - wife is seeking transfer of Hindu Marriage Petition No. A - 339 of 2022 pending in the Family Court, Thane filed by respondent - husband for getting divorce, to the Court of C.J.S.D., Dhule.

According to the applicant - wife, she is not having any independent source of income and residing at Shirpur, Dhule, which is more than 300 Kilometers away from Thane. Moreover, she has also filed proceeding under the provisions of Pooja K.

957-MCA-44-2023 Protection of Women from Domestic Violence Act, 2005 against the respondent - husband and his family members, wherein the respondent has already appeared. There is no oppose to the application and considering the fact that, the respondent is attending the dates at Dhule, following order is passed :-

ORDER

(i) The application is hereby allowed.

(ii) Hindu Marriage Petition No. A - 339 of 2022 pending in Family Court, Thane is transferred to the Court of Civil Judge Senior Division, Dhule for disposal according to law.

(iii) The respondent is directed to appear before the Court of Civil Judge Senior Division, Dhule on or before 25th July, 2023.
