Applicants pray that by following order passed in similarly situated matters 75% of the amount deposited shall be disbursed on furnishing undertaking and 25% of the amount deposited shall be disbursed on furnishing solvent security/surety. 3.

These submissions are opposed by the learned counsel for the acquiring body and the learned. A. G. P. for the respondent/State.

My attention is adverted to the order dated 13.11.2025 passed by this Court in Civil Application No. 12769 of 2024 in First Appeal Stamp No. 17412 of 2023. The rival submissions were considered in that matter and this Court found it fit to disburse 60% of the amount deposited on furnishing undertaking and 40% of the amount deposited on furnishing solvent surety/security. I propose to follow the same course. 4.

The civil application is partly allowed. The applicants shall be entitled to receive 60% of the amount deposited with accrued interest on furnishing undertaking and remaining 40% of the amount deposited with accrued interest on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court.
