Appellants did not take necessary steps and legal heirs of respondent No.1 are coming up with the present civil application.

The cause of action survives against heirs of deceased/respondent No.1 Badesaheb.

For the reasons stated in the civil application, it stands allowed in terms of prayer clause "B". Civil application is disposed of accordingly.
