Learned Counsel for the applicants submits that on the date of the previous hearing, he was busy in another matter and as such could not remain present at the time of hearing of this application.

We have also heard learned A. P. P. for RespondentState. By an order dated 31.01.2022, we have dismissed Criminal Application No. 1563 of 2021, for want of prosecution.

{2} In view of the same and for the reasons stated in the application, Criminal Application No. 437 of 2022 is allowed in terms of prayer clause "B", subject to cost of Rs.500/- to be paid to the Library of Advocates' Association of Bombay High Court, Bench at Aurangabad.

Criminal Application No.437 of 2022 is accordingly disposed of.
