Heard the learned counsel for the parties.

By way of the present writ petition, the petitioner challenges the order dated 4.1.2024 below Exh. 28 in C.M.A. No. 855/2022 passed by the learned 10th Jt. Civil Judge, Senior Division, Aurangabad. 3.

C.M.A. No. 855/2022 is filed by the respondent Nos. 2 and 3 in this petition for grant of heirship certificate to which the petitioner herein filed objection below Exh. 28 for rejection of the heirship certificate and by framing preliminary issue in respect of the jurisdiction of the Trial Court. 4.

The Trial Court held that the petitioner's objection cannot be entertained seperately at that stage and the objection is read and recorded by the Trial Court and taken on record.

In view of the same, nothing survives in the petition. The writ petition is dismissed.
