The learned AGP appearing on behalf of the petitioners submits on instructions that the impugned judgment of the Industrial Court dated 04/04/2002 has been complied with. All benefits have been extended to the respondent and he has also superannuated from employment.

Though the learned Advocate for the respondent confirms the said statement on instructions, he submits that this Court had granted him the liberty to approach the Government for the time bound promotion and benefits incidental thereto vide order dated 20/11/2017, preceded by the order dated 23/01/2015 in CA NO.3672/2014. The Government has turned down the claim of the respondent on the ground that this petition is pending. khs/MAY 2019/2742

Considering the above, keeping in view that no interim relief was granted to the petitioners and taking into account the above recorded statement, this petition is rendered infructuous and stands disposed off. Rule is discharged.

In view of the above, if the respondent is aggrieved by the decision of the Geologist dated 10/06/2016 rejecting his claim for a time bound promotion, he would be at liberty to assail the said decision by resorting to a remedy as may be permissible in Law. ( Ravindra V.Ghuge, J.) khs/MAY 2019/2742
