The learned Counsel for the appellant-Insurance Company submits that he received oral communication from the appellant-Company for withdrawing the instant appeal. The learned Counsel for the original claimantsRespondents No.1 to 4 also consented for the same and submits that the Cross Objection fled by the original claimants bearing XObjection No. 71 of 2022 also may be allowed to be withdrawn in view of oral instructions received by him.
Considering the submissions, First Appeal No. 1314 of
{2} fa131721.odt 2021 along with Cross Objection No. 71 of 2022 allowed to be withdrawn and stand disposed of as withdrawn. In view of such withdrawal, pending C. A. No. 7876 of 2021 also stands disposed of. Refund of court fee to the appellant in F. A. No. 1314 of 2021 and Petitioners in Cross Objection No. 71 of 2022, as per rules. The deposited amount by the appellant-Insurance Company be paid to the claimants along with accrued interest thereon as per the apportionment done by the learned Tribunal. It appears that the learned Tribunal has directed to keep amount of Rs. 2,00,000/-, given to the share of petitioner no.3, in Fixed Deposit in any Nationalised Bank for the period of three years, since she was minor at the relevant time. Now the Respondent No.3 - Mahadabai (Petitioner No.3 in Cross Objection) has attained majority. As such, the amount of her share along with accrued interest thereon be paid to her.
