This is an application for condonation of delay of 86 days in taking exception to the order passed in MACP No. 660/2008 by Adhoc District Judge -2 and Member, MACT Nanded, on 13.07.2011. 2.

Applicant No. 1 is the widow, Applicant Nos. 2 and 3 are children and Applicant Nos. 4 and 5 are the parents of deceased Pratapsingh who died on 03.03.2008 in a motor vehicular accident. 3.

No reply is filed by the Respondents. For the reasons mentioned in the Application which have gone unchallenged, this is a

- 2 - fit case for condonation of delay of 86 days which is neither inordinate nor deliberate.

In view of above, Application stands allowed in terms of prayer clause 'B'.

Contention of learned counsel for Respondents with regard to statutory interest would be considered at the time of final decision of the Appeal.
