Learned counsel for the petitioner, on instructions, seeks permission to withdraw the instant petition with liberty to approach the competent Civil Court for establishing the rights of the petitioner. He also seeks direction to the respondents to consider the claim of the petitioner on the basis of the decision that will be taken by the competent Civil Court.

In view of the above, the petition is disposed of with liberty to the petitioner to approach the competent Civil Court. On the basis

30-wp2336.2022 of the decision taken by the Civil Court, the respondents/authorities shall, thereafter, consider and decide the claim of the petitioner for pensionary benefits.
