PER COURT:- 1.

The grievance of the petitioner is that the permanent approval to the appointment of the petitioner to the post of Headmaster is not granted. He should be granted permanent approval to the post of Headmaster. Since 2015, the petitioner is only granted powers to sign the salary bills as in-charge Headmaster.

It appears that, there is a dispute in the management. The Assistant Charity Commissioner, Nanded Region in Inquiry No.1367/2010 dated 28.09.2010 had passed an order directing the Education Officer to take appropriate steps as per law to appoint the staff in the school of the Trust

(2) 18-wp-1562-2018 in absence of lawful committee.

In view of the above, the Education Officer shall consider the seniority list, eligibility, Circular dated 06.03.2010 issued by the State Government and thereafter take decision whether approval can be granted to the petitioner as Headmaster.

The Education Officer shall consider roster, qualification and all other relevant aspects of the matter as stipulated under law. The Education Officer shall take decision upon it within a period of three months.

Writ Petition is disposed of. No costs.
