IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 2886 OF 2018 SARJERAO LIMBAJI KOTULE AND ANOTHER VS.

CHANDRAKANT SHANTILAL NIMAWANT ...

Advocate for Petitioners : Shri Ajinkya Reddy ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 21st March, 2018.

PER COURT :- 1] This matter is heard for some time.

2] It appears that the petitioner has an alternate remedy under Order 41 Rule 19 of the Code of Civil Procedure by preferring an application for seeking re-admission of the appeal, which has been dismissed in default.

3] Considering the above, this petition is disposed of with liberty to the petitioners to avail of the said remedy. The time spent in this Court from 06/02/2017 till the passing of this order today would be a good ground for condonation of delay.
