Having heard respective counsels for some time, it is an admitted position that an RTS Appeal No.104/2023 preferred by the petitioners is pending before the Additional Collector, Ahmednagar which is scheduled for hearing on 18th April, 2023.

In response to the Court's query, learned counsel for respondent submit that he having received the notice in the said appeal, he shall appear on 18th April, 2023 and shall complete the pleadings in any case by 30th April, 2023. The aforesaid statement is accepted as an undertaking to this Court.

In view of the above, we direct the Additional Collector, Ahmednagar to decide the pending RTS Appeal No.104/2023 of the petitioners expeditiously and in any case by 31st May, 2023 without being influenced by the disposal of the present petition. 1/2

Needless to clarify that this Court has not gone into the merits of the matter.
