Heard learned counsel for the applicant and the learned A.P.P. for the respondent-State.

The applicant is convicted by the learned J.M.F.C. Ausa by order dated 9.11.2011 in Regular Criminal Case No. 192 of 2005 for the offence punishable under Section 324 of I.P.C. and sentenced to suffer S.I. for 12 months and to pay fine of Rs.7000/- i/d to suffer S.I. for 15 days. The learned Additional Sessions Judge, Latur by order dated 30.01.2016 confirmed the said order and accordingly dismissed the criminal appeal No. 134 of 2011. Being aggrieved by the same, the applicant-original accused has preferred criminal revision application, which is admitted by this Court today by passing separate order.

Learned counsel for the applicant submits that during the course of trial and even during pendency of the criminal appeal, the applicant was on bail. Learned counsel further submits that the applicant has deposited fine amount before the trial court. In view of this, following order is passed:-

O R D E R

I.

The substantive part of the sentence awarded by the learned J.M.F.C. Ausa in Regular Criminal Case No. 192 of 2005 and confirmed by the Additional Sessions Judge, Latur in Criminal Appeal No. 134 of 2011 is hereby suspended till disposal of criminal revision application. II.

The applicant -Vishnu s/o Chenda Manjare be released on bail on his furnishing P.R. bond of Rs.5000/- with one surety in the like amount. Bail before the trial court. III.

Criminal application is disposed of.
