Mr. Bodkhe, the learned counsel for the petitioner states that, since three years the petitioner school was having centre for conducting H.S.C. Examinations. Earlier eight schools were attached to the petitioner centre. Last year also eight schools were attached to the petitioner centre. The learned counsel submits that, abruptly, this year centre has been cancelled for conducting H.S.C. Examinations. The students have to travel long distance of seven to eight kilometers. The school is situated in hilly area. All these aspects are not considered by the authorities. Even another school is situated in an adjacent

2 wp 1729.17 village, which forms part of group gram panchayat. There are 31 students of said school.

Miss Mahajan, the learned counsel for the respondent No. 2 submits that, there are less students with the petitioner school. The school of the petitioner is attached with the school which is at the distance of 4.7 k.m.

It appears that, initially show cause notice was issued to the petitioner school. Reply was solicited in December 2016. No doubt, there are representations by the students and the parents. However, it needs to be considered that, the petitioner school has only 71 students. The other schools who have been attached to another centre did not have objection about the same. Even another village which is attached to the petitioner school has only 31 students. There would be only hardly 102 students. 4.

Considering aforesaid conspectus of the matter, it would not be appropriate for us to intervene in the matter. In view of that, the writ petition is disposed of. No costs. [ K. L. WADANE, J. ] [ S. V. GANGAPURWALA, J. ] bsb/Feb. 17
