Heard learned Counsel for the respective parties. 2.

By way of this petition, the petitioners are challenging the order 16.11.2018 passed by the District Judge-1, Osmanabad, in Misc. Civil Appeal No.67 of 2015, whereby the appeal filed by the petitioners came to be dismissed thereby confirming the order dated 10.09.2015 passed below Exhibits 5 and 46 by the learned 4th Jt. C.J.S.D., Osmanabad. 3.

Learned Counsel appearing for both sides submit that the suit is of the year 2014 and that the plaintiff has already led evidence. In view thereof, the petition is required to be disposed of without entering into the merits of the matter.

Considering the aforesaid submissions, the Writ Petition stands disposed of.

The learned Trial Court is directed to decide the suit within a period of one (1) year from today.

This Court vide its order dated 07.04.2022 directed the parties to maintain status-quo and it has been operating since then, the same shall continue until the disposal of the suit.

The learned Trial Court shall decide the suit on its own merits, without being influenced by any observations made herein. 8.

All the points are kept open.
