Heard learned advocates for the parties.

Learned advocate for the applicant points out contents of paragraphs No. 4 and 5 of the civil application, which according to him, to a large extent, would show that there has been no deliberation or intention underlying making delayed approach. 3.

Though learned advocate for the respondent purports to resist the application, the reasons referred to in paragraphs No. 4 and 5 of the civil application are not overcome by any plausible and credible material.

In view of the same, civil application is allowed in terms of prayer clause "B" and is disposed of.
