ORDER:

1.

Learned AGP, on instructions, states that the Scrutiny Committee has sent the matter for vigilance in the last week. 2.

In view of the fact that the validation proceeding is pending, we pass the following order.

ORDER

(i) The respondent No. 4 - Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner expeditiously, preferably within six months from today.

2 Sr4 WP1674.2018 (ii) The petitioner shall cooperate with the Committee in expeditious disposal of the proceeding.

(iii) The petitioner shall appear before the Committee on 05.03.2018.

(iv) The impugned notice is quashed and set aside. (v) The respondent-employer shall not take adverse action against the petitioner only on the ground that the validation proceeding is pending.

(vi) The respondent-employer can take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding.
