IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD FIRST APPEAL NO.772/2010 The State & others ...

Appellant

Versus

Vitthal Dadarao Jadhav ...

Respondent None present

CORAM:

VIJAY S.KULKARNI REGISTRAR (JUDL) DATED:

11/08/2015 1.

Perused the record and proceeding. The objection notified by the office is that the notice of sole respondent is returned unserved on the ground that he is dead. Perused bailiff report filed on record. It is apparent from the bailiff report that the respondent is reported to be dead prior to eight months of 27th November 2014. Thereafter no steps have been taken by the appellant to bring on record the legal heirs of deceased respondent. There is no representation on behalf of appellant. About five chances have been given to the appellant for taking necessary steps. Since there is a sole respondent, I find no difficulty to pass following order.

The appeal stands abated.
