The challenge herein is to the order rejecting the application for release of vehicle namely, Maruti - OMNI bearing registration No.MH-15-GL-4387, allegedly used in commission of the offence under Section 363 of Indian Penal Code. 3.

Learned APP for the respondent objects the petition 4.

The petitioner is not accused in the said crime. When the vehicle was seized, its complete description must have been noted in the seizure panchnama. No useful purpose would be served by detaining the vehicle at the police station, pending trial.

In view of the above, the petition is allowed in terms of prayer clause (B), on the conditions to be imposed by learned Sessions Judge in-charge of the case.
