DATE :
07.03.2025 ORDER :
1.
By instant application, prayers are made for grant of regular bail on account of arrest of the applicants in crime no.0013 of 2025 registered at Udgir Rural Police Station, District Latur for offences punishable under Section 143 r/w 3(5) of the Bharatiya Nyaya Sanhita (BNS) and Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956.
-22.
Learned counsel submitted that applicants are arrested in above crime on 08.01.2025. That, there is false implication. That, applicants are shown as accused nos.3 and 4. That, alleged raid was conducted by police on secret information. Main allegations are directed against other two accused. That, in view of nature of allegations, nothing is shown to be recovered at their instance. That, applicants are ready to abide all and any conditions imposed by this Court. 3.
Learned APP pointed out that applicants were found to be involved with other accused, indulging in acts of immoral trafficking. That investigation is still in progress, and hence he opposed relief. 4.
After considering the above submissions and on going through the FIR dated 08.01.2025, it is apparently at the instance of police official, wherein it is reported that on secret information, raid was planned, dummy customer was sent and in all four persons were taken in custody, including present applicants. That, three women named in the FIR, who are said to be found on the spot, are grown up ladies. Thus, prima facie, no minor has been involved in the above offence. Therefore, when there is nothing shown to be recovered or discovered at the instance of present applicants, relief of bail deserves to be granted. Hence, I proceed to pass the following order:
-3ORDER I.
The application is allowed.
