Heard learned counsel for applicant. It is his contention that petition was dismissed before issuance of notice to respondents and as such no notice is necessary to be issued to them. At this stage, it is his further contention that the delay of 91 days is satisfactorily explained and that error otherwise no prejudice will cause to respondents if the same is condoned.

Since petition was dismissed at the stage before issuance of notice to the respondents, this Court finds no impediment in entertaining the application in their absence. Hence notice to these respondents is dispensed with at this stage.

The delay is not inordinate or deliberate and the same is explained satisfactorily. Reasons recorded in the application justifies the 82-CA-1672-2025.odt

condonation of delay. Hence, application stands allowed. 4.
