Mr. Irale Patil, learned counsel for the petitioner submits that one similarly situated employee Mr. Kumbhkarn Vishwas Shivling has been granted the placement in Group - C as per his qualification, however, the petitioner is denied the same benefits.

Mr. Tandale, learned counsel for respondent submits that the benefit to Mr. Kumbhkarn was given under the direction of the Commissioner. Mr. Kumbhkarn had approached the Commissioner by filing appeal and pursuant thereto the order was passed by the Commissioner.

Mr. Irale Patil, learned counsel submits

(2) 1003-wp-1620-2018 that the petitioner would also approach the Commissioner.

The petitioner may approach the Commissioner as may be permissible in law.

Needless to state that the Commissioner would decide the application/appeal of the petitioner on its own merits and expeditiously. 6.

Writ Petition disposed of. No costs.
