This is an Application for suspension of substantive sentence. 2.

Though the Appeal is of the year 2024, the papers show that, the Appeal was preferred after the delay of 2600 days. The Session Case is of the year 2014. The Appellant is behind the bars since then. Learned Advocate for the Appellant is appearing through legal aid. Considering his aspects, the Appeal is heard finally. 3.

Heard the learned Advocate Mr. Gaikwad for the Applicant and Ms. Bhosle, learned APP for the Respondent - State. 4.

After hearing both the sides and perusing the evidence available on record, in our view, the Appellant has good case on merits, which may result in his acquittal. Hence, the following order:

ORDER

(i) Criminal Application is allowed.

(ii) The substantive sentence imposed by the learned Additional Sessions Judge, Vaijapur, District Aurangabad vide Judgment and Order dated 14/10/2016 on the Applicant / Appellant, namely, Lahanu Raghunath More, is suspended.

(iii) The Applicant / Appellant be released on bail on furnishing P.R. Bond of Rs.15000/- [Rupees Fifteen Thousand Only]. (iv) Bail before the Trial Court.
