VERSUS
UNION OF INDIA AND OTHERS ...
Advocate for Applicants : Mr. Menzes Joslyn A. holding for Mr. Prashant M. Nagargoje DSGI for Respondent No.1 : Mr. A. G. Talhar ...
CORAM : S. G. MEHARE & SHAILESH P. BRAHME, JJ.
DATE : 10-03-2025 PER COURT:- 1.
Heard the learned counsel for the applicants. 2.
Issue notice to the respondents.
3.
The learned D.S.G.I. waives service of notice for the respondent No.1.
4.
The applicants/petitioners did not remove the office objection even after the order was passed by the Court before 889 days. The very famous reason for not removing the office objections is 'inadvertent mistake of the lawyer'. We are getting many such applications for the same reason. It is a matter of diligence.
13-CA-2693-25.odt 5.
Prima facie, it appears that the orders of the Court are not respected. So, there should not be a casual relief to be granted. However, to protect the interest of the litigants and not to punish them for the mistake of the lawyer, we allow the application on the condition to deposit the cost of Rs.5,000/- (Rs.Five Thousand) with the Registry, High Court, Aurangabad for utilization of Dispensary, High Court, Aurangabad.
6.
The writ petition be restored to its original position after depositing the cost.
7.
The petitioners shall remove the office objection/s within three weeks from today.
