We have heard the learned counsel for the petitioner and the learned Assistant Government Pleader for respondents. 3.

The grievance of the petitioner is that, the fair price shop of the petitioner was cancelled on account of criminal case. The petitioner has been acquitted in the criminal case, as such filed an application for restoration of fair price shop.

It appears that, Deputy Commissioner (Supply) had referred the same to the District Supply Officer, Aurangabad vide letter dated 02.12.2016 (Exhibit - D page 24). 5.

Considering the above, the District Supply Officer i. e. the respondent No. 3 shall take decision upon the same on its own merits expeditiously and in accordance with policy and preferably within a period of seven (07) months from today. The writ petition is disposed of. No costs.
