Heard the respective learned counsels for the parties. 2.

The appeal has been preferred on the ground that the deceased rammed his vehicle into the stationary vehicle. The incident happened in night. The incident is not denied. Considering the reasons assigned by the learned Tribunal, the application deserves to be allowed. Hence, the following order :

O R D E R

(i) The application is allowed.

(ii) The applicants are allowed to withdraw entire amount deposited with this Court with accrued

930-CA.2346-24.odt interest on the undertaking to deposit the money, if the impugned judgment and award is reversed. (iii) The share of applicant No.3 be deposited in a fixed deposit for two (2) years in any of the Nationalized Bank of the guardian mother's choice with a right to receive the interest at quarterly rest.

(iv) Call R and P.

(v) List the matter in due course.
